2	subject matter 2	The reason behind this is that handcuffing is considered animalising the human, a method of humiliating and torturing the prisoner. Merely because he is a prisoner, the /state cannot rob him of basic human dignity and humiliate him and treat him like an animal. Arresting without handcuffing therefore, is a practice which (in Krishna Iyer's words) "permit[s] the peaceful co- existence of custodial conditions and basic dignity". Despite Supreme Court orders prohibiting handcuffing, flagrant violations continue. Recently, the Madurai High Court ordered two constables to pay Rs 5000 each in compensation for handcuffing a detainee without permission from the judicial magistrate. In India, handcuffing detainees and prisoners remains widely prevalent despite judicial interpretation clearly establishing that it is against the protection of right to life guaranteed under Article 21 of the Constitution. Case law on handcuffing in India is considered among the most progressive in the world. Despite Supreme Court orders prohibiting handcuffing, flagrant violations continue. In Prem Shankar Shukla vs. Delhi Administration (1980) the Court held that handcuffs are prima facie inhuman, unreasonable, and at first blush arbitrary without fair procedure and objective monitoring.
